Telephone Equipment Limited Warranty Statement

Your Parabit Systems telephone equipment comes with a one (1) year limited hardware warranty excluding modular cable. Parabit Systems, Inc. (Parabit) warrants the telephone equipment against defects in material and workmanship for a period of one (1) year from the date of purchase from Parabit or an authorized Parabit agent. This warranty applies only to the original purchaser of the telephone equipment and is not transferable. This warranty does not cover any incompatibilities due to telephone line voltage, polarity, noise and phone circuit features or any other related circuit or system configuration in which the telephone equipment interfaces. Proof of purchase will be required before any warranty consideration by Parabit occurs.
Shipping/Customs charges associated with the return of equipment to Parabit for repairs are the responsibility of the purchaser. All shipping/customs charges to and from Parabit for repairs not covered by the one (1) year limited hardware warranty will be paid by the client. Parabit will pay for the shipment of equipment via standard UPS ground or it’s equivalent to any destination within the continental United States, that was returned for repair where the repair was due to normal wear and tear and the return is within the one (1) year limited hardware warranty guideline.
This warranty does not cover any damage caused by negligence, non-authorized modifications/service, incorrect installation or incorrectly configured or defective telephone line that operates the Parabit phone.
This warranty does not apply if the product has been damaged by a power surge from a phone line or electrical service, accident, abuse misuse, or misapplication, nor as a result of service to the product.
PARABIT IS NOT RESPONSIBLE FOR ANY LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF, OR INABILITY TO USE, THIS PRODUCT. THIS INCLUDES DAMAGE TO PROPERTY AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURY. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Some states do not allow limitation of implied warranties, or exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. This warranty gives you specific legal rights. You may have other rights which may vary from state to state.
This warranty applies only to this product, and is governed by the laws of the State of New York.

Phone Tester Software Licensing Statement


YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS BEFORE OPENING THIS PACKAGE. BY OPENING THIS PACKAGE, YOU ARE AGREEING TO BE BOUND BY THESE TERMS AND CONDITIONS WITH REGARD TO THE PARABIT SOFTWARE PACKAGES ("Software") ENCLOSED HEREIN. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU SHOULD PROMPTLY RETURN THE PACKAGE UNOPENED AND YOUR MONEY WILL BE REFUNDED.

LICENSE

1. License: This Agreement grants you, the Licensee, a license to:

(a) use the Software on a single computer system.

(b) make one copy of the Software in machine readable form solely for back-up purposes provided you reproduce Parabit's copyright notice and any proprietary legends.

2. Restrictions: You may not distribute copies of the Software to others or electronically transfer the Software from one computer to another over a network. You may not use the Software from multiple locations of a multi-user or networked system at the same time. The Software contains trade secrets and in order to protect them you may not decompile, reverse engineer, disassemble, or otherwise reduce the Software to a human-perceivable form. YOU MAY NOT MODIFY, ADAPT, TRANSLATE, RENT, LEASE, LOAN, RESELL FOR Profit, DISTRIBUTE, NETWORK, OR CREATE DERIVATIVE WORKS BASED UPON THE SOFTWARE OR ANY PART THEREOF.

3. Ownership of Software: As Licensee, you own the media upon which the Software is recorded or fixed, but Parabit retains title and ownership of the Software recorded on the original media and all subsequent copies of the Software regardless of the form or media in which or on which the original and other copies may exist. This license is not a sale of the Software or any copy.

4. Confidentiality: You agree to maintain the Software in confidence and to not disclose the Software to any third party without the express written consent of Parabit. You further agree to take all reasonable precautions to preclude access of unauthorized persons to the Software.

5. Termination: This license is effective until terminated. This license will terminate automatically without notice if you fail to comply with any provision hereof. Upon termination you shall destroy the written materials and all copies of the Software, including modified copies, if any.

6. Limited Warranty: Parabit warrants only that the media upon which the Software is furnished will be free from defects in material or workmanship under normal use and service for a period of thirty (30) days from the date of delivery to you. PARABIT MAKES NO OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, AND DOES NOT WARRANT THAT THE SOFTWARE WILL BE MERCHANTABLE OR FIT FOR ANY PARTICULAR PURPOSE.

7. Patents, Copyrights: PARABIT MAKES NO OTHER WARRANTY, EXPRESS, IMPLIED OR STATUTORY, THAT THE SOFTWARE OR ITS USE IS OR SHALL BE FREE FROM CLAIMS OF INFRINGEMENT OF PATENT, COPYRIGHT OR OTHER INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES.

8. Limitation of Damages: PARABIT SHALL NOT BE LIABLE FOR INDIRECT, SPECIAL OR INCIDENTAL EXPENSES OF ANY KIND ARISING UNDER THIS AGREEMENT OR FROM YOUR USE OF THE SOFTWARE.

9. Limitation of Remedies: Parabit's entire liability and your exclusive remedy shall be:

(a) the replacement of any media not meeting Parabit's limited warranty which is returned to Parabit; or

(b) if Parabit or its distributor is unable to deliver replacement media which is free of defects in materials or workmanship, you may terminate this Agreement by returning the Software and your money will be refunded.

10. General: This is the only Agreement between you and Parabit relating to this Software. This Agreement shall be governed by New York law except as to copyright matters which are covered by Federal law. This Agreement is deemed entered into at Floral Park, New York by both parties. Should any provision of this Agreement be declared unenforceable in any jurisdiction, then such provision shall be deemed to be severable from this Agreement and shall not affect the remainder hereof. All rights in the Software not specifically granted in this Agreement are reserved by Parabit.

Hard Drive and Data Storage Warranty

Each component manufacture may have its own warranty statement.  Those most important are listed here.

Maxtor DVR 100-160 gig drives.

Limited Warranty Statement

Maxtor's warranty obligations are limited to the terms set forth below:

Maxtor warrants to the original consumer purchaser that new Maxtor disk drives will be free from defects in material and workmanship for the Standard Warranty Period. The start of the warranty period is the date of the last production for that drive, plus three months. If a drive is purchased from Maxtor or Maxtor's authorized reseller after the last production date for that drive, and proof of purchase can be provided, then the start of the warranty period is the documented date of such purchase.

For replacement disk drives the warranty on the replacement drive is the remainder of the warranty on the original drive or 90 days, whichever is longer.

For disk drives obtained under the Maxtor Upgrade Program, the warranty period is the remainder of the warranty period, as defined above, for that drive.

If the customer discovers a defect, Maxtor will, at its option, repair or replace the disk drive at no charge to the customer, provided it is returned during the warranty period, with transportation charges prepaid, to Maxtor in Irving, TX.; Bray, Ireland or Singapore. Drives must be properly packaged in Maxtor packaging or Maxtor approved packaging to obtain warranty service.

For warranty service, contact Maxtor at 1-800-2MAXTOR (IN USA) to obtain a "Return Material Authorization (RMA) number." A copy of the receipt or a bill of sale bearing the appropriate Maxtor serial number and model number may be required for warranty service.

Warranty Exclusions;

  • Normal wear and tear
  • Abuse, unreasonable use, mistreatment, or neglect
  • Damage caused during installation of the disk drive
  • Damage caused by the equipment or system with which the disk drive is used
  • Damage caused by modification or repair not made or authorized by Maxtor
  • Disk drives whose Maxtor Serial Number and/or Material Number label have been removed, torn or defaced
  • Damage caused by use of non-Maxtor packaging
  • Damage caused by improper or improperly used packaging
  • Damage caused by lack of ESD protection
  • Drives that are determined to be stolen.

THIS WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS, WHETHER ORAL OR WRITTEN, EXPRESSED OR IMPLIED. MAXTOR SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND AGAINST INFRINGEMENT. No Maxtor dealer, agent or employee is authorized to make any modification, extension or addition to this warranty.

MAXTOR IS NOT RESPONSIBLE FOR SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS PROFITS, DOWNTIME, GOODWILL, DAMAGE OR REPLACEMENT OF EQUIPMENT AND PROPERTY, AND ANY COSTS OF RECOVERING, PROGRAMMING OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH MAXTOR DISK DRIVES.

Some states do not allow the exclusion or limitation of incidental or consequential damages or exclusions of implied warranties, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

Warranty Policy and Limitations

Western Digital Corporation ("WDC") values your business and always attempts to provide you the very best of service.

No limited warranty is provided by WDC unless your WDC Product ("Product") was purchased from an authorized distributor or authorized reseller. Distributors may sell Products to resellers who then sell Products to end users. Please see below for warranty information or obtaining service. No warranty service is provided unless the Product is returned to an authorized return center in the region (Americas, Europe-Middle East-Africa, or Asia Pacific) where the Product was first shipped by WDC.

If your Product was purchased as a component integrated within a system by a system manufacturer, no limited warranty is provided by WDC. Please contact the place of purchase or the system manufacturer directly for warranty service.

Return Material Authorization

No Product may be returned directly to WDC without first contacting WDC for a Return Material Authorization ("RMA") number. If it is determined that the Product may be defective, you will be given an RMA number and instructions for Product return. An unauthorized return, i.e. one for which an RMA number has not been issued, will be returned to you at your expense. Authorized returns are to be shipped prepaid and insured to the address on the RMA in an approved shipping container. Your original box and packaging materials should be kept for storing or shipping your Product.

Limited Warranty

WDC's limited warranty provides that, subject to the following limitations, each Product will be free from defects in material and workmanship and will conform to WDC's specification for the particular Product.

Duration of Warranty

The limited warranty extends only for the period of time set forth in the Product documentation. The period commences from the date of manufacture appearing on the Product label of the original Product purchase. To verify this period for your Product, please click on Warranty Inquiry System. In the United States, some states do not allow limitations on how long implied warranties last, so the above limitation may not apply to you.

Disclaimer of Warranties

There are no warranties which extend beyond the face of the WDC limited warranty. WDC disclaims all other warranties, express or implied, regarding the Products, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. In the United States, some laws do not allow the exclusion of the implied warranties.

Your Use of the Product

WDC will have no liability for any Product returned if WDC determines that:

  • The product was stolen from WDC.
  • The asserted defect:
    1. is not present,
    2. cannot reasonably be fixed because of damage occurring when the Product is in the possession of someone other than WDC, or
    3. is attributable to misuse, improper installation, alteration (including removing or obliterating labels), accident or mishandling while in the possession of someone other than WDC.
  • The Product was not sold to you as new.

Limitation of Remedies

Your exclusive remedy for any defective Product is limited to the repair or replacement of the defective Product.

WDC may elect which remedy or combination of remedies to provide in its sole discretion. WDC shall have a reasonable time after determining that a defective Product exists to repair or replace a defective Product. WDC's replacement Product under its limited warranty will be manufactured from new and serviceable used parts. WDC's warranty applies to repaired or replaced Products for the balance of the applicable period of the original warranty or ninety days from the date of shipment of a repaired or replaced Product, whichever is longer.

Limitation of Damages

WDC's entire liability for any defective Product shall in no event exceed the purchase price for the defective Product. This limitation applies even if WDC cannot or does not repair or replace any defective Product and your exclusive remedy fails of its essential purpose.

No Consequential or Other Damages

WDC has no liability for general, consequential, incidental or special damages. These include loss of recorded data, the cost of recovery of lost data, lost profits and the cost of the installation or removal of any Products, the installation of replacement Products, and any inspection, testing, or redesign caused by any defect or by the repair or replacement of Products arising from a defect in any Product.

In the United States, some states do not allow exclusion or limitation of incidental or consequential damages, so the limitations above may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

On-Line Warranty Inquiry

The new on-line Warranty Inquiry System will provide warranty status based on the serial number of the Product.

DVR Liability and Warranty

Parabit Systems warrants the original owner that the product delivered will be free from defects in material and workmanship for one (1) year following the date of purchase. This warranty does not cover any damage attributable to erroneous installation of the product.

THIS WARRANTY IS THE SOLE WARRANTY AND IS IN LIEU OF ANY OTHER WARRANTY, WHETHER EXPRESSED, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANT-ABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT, OR ANY WARRANTY ARISING OUT OF ANY PROPOSAL, SPECIFICATION OR SAMPLE.

NOTWITHSTANDING THE FOREGOING PARABIT SYSTEMS SHALL HAVE NO LIABILITY FOR ANY INDIRECT OR SPECULATIVE DAMAGES (INCLUDING, WITHOUT LIMITING THE FOREGOING, CONSEQUENTIAL, INCIDENTAL AND SPECIAL DAMAGES) ARISING FROM THE USE OF OR INABILITY TO USE THIS PRODUCT, WHETHER ARISING OUT OF CONTRACT, NEGLIGENCE, TORT, OR UNDER ANY WARRANTY, IRRESPECTIVE OF WHETHER PARABIT SYSTEMS HAS ADVANCE NOTICE OF THE POSSIBILITY OF ANY SUCH DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF USE, BUSINESS INTERRUPTIONS, THEFT, PREMISE VANDALISM, LOSS OF PHYSICAL ASSETS AND LOSS OF PROFITS, NOTWITHSTANDING THE FOREGOING, PARABIT SYSTEMS' TOTAL LIABILITY FOR ALL CLAIMS UNDER THIS AGREEMENT SHALL NOT EXCEED THE PRICE PAID FOR THE PRODUCT. THESE LIMITATIONS ON POTENTIAL LIABILITIES WERE AN ESSENTIAL ELEMENT IN SETTING THE PRODUCT PRICE. PARABIT SYSTEMS NEITHER ASSUMES NOR AUTHORIZES ANYONE TO ASSUME FOR IT ANY OTHER LIABILITIES.

This warranty does not cover replacement of products damaged by abuse, accident, misuse, neglect, alteration, repair, disaster, black out, act of god, improper installation or improper testing.

Return Policy on Stock Items

Purchases can be returned for refund within 30 days from date of purchase. Items must be returned at customers expense by a traceable shipping system. Parabit can not be responsible for returned items that are never received, using the (RMA) Acceptance Policy listed below. Please review your packing slip to determine return procedures for your purchase. All items must be accompanied by a copy of the original receipt and must be in the original, undamaged packaging. No refunds are allowed after 30 days.

A restocking fee equal to 35% of the purchase price will be charged on any returned item, unless the item is defective and exchanged for the exact same item (fee not applicable in Hawaii). The 35% restocking fee will be assessed at the time of refund. Shipping charges can not be refunded in any way.

Parabit will not accept the return of any item if the UPC code has been removed from the packaging.

Refunds on purchases made with a credit card will be posted to the original credit card used at the time of sale.

 

Acceptance Policy

Contact the Parabit Support Center at Phone888 to obtain your Return Authorization (RMA) number and details including mailing address and procedures. RMA requests are valid for 10 days from date of issuance. We are unable to accept returns without an RMA request.

  • To receive a refund or credit, your purchase must be returned with shipping and insurance pre-paid in "as new" condition, in original box and packaging, and with all warranty cards, manuals and accessories. Any variance from these conditions could result in delay or forfeiture of your refund.
  • Items May not be disassembled or modified in any way from the original shipping condition.
  • A restocking fee equal to 35% of the purchase price will be charged on any returned item, unless the item is defective and exchanged for the exact same item (fee not applicable in Hawaii). The 35% restocking fee will be assessed at the time of refund or exchange. Shipping and insurance charges may not be refunded.
  • Refunds on purchases made with a credit card will only be credited to the same card.
  • Refunds or credits are issued after receipt and inspection of returned goods.

All returns must be shipped prepaid. Parabit will refund shipping charges for defective/damaged merchandise only. Returns Exceptions
Enclosures, Topers, Displays and other fabricated items that are not readily resalable to the general public contain their own return polices and procedures that are not covered here. Tooling, Materials and shipping can not be refunded.
